Any mandated reporter who intentionally or negligently fails to report maltreatment will be liable for damages caused by their failure.
Under the MS 626.557 subd. 7, nothing in the law imposes vicarious liability for the acts or omissions of others.
Moreover, a person can be disqualified from providing direct contact services if they fail to make a required report according to MS 245C.15, subd. 4(b). Similarly, facilities that have failed to make a mandated report can be subjected to a fine.
