5.3.1 Federal Prohibition

Any event where a person is expressly prohibited by federal law from revealing any information that can be used to identify a patient in connection to a report of suspected maltreatment.

However, if the vulnerable adult or their guardian, conservator, or legal representative has consented to disclose such information by conforming to any federal requirements, they are an exception.

People who are restricted by federal law from reporting suspected maltreatment are required to immediately seek consent to be able to make a report.
